Information we collect
Information you provide: information you input when creating a user account or placing an order, as well as any information you otherwise provide to us, such as by email. This information typically includes your name, address, and email address.
Technical data: technical data and related information pertaining to the functionality of the website on your device including but not limited to technical information about your device, system and application software, that is gathered periodically to facilitate the provision of Service updates, product support and other services to you (if applicable). When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as it is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

We collect information because it is useful to provide the services offered by Titan Biomedical. We limit access to this data to those employees, contractors, affiliates, and agents who require that access to facilitate the proper delivery of the Services we offer.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS AND CONDITIONS
User Opt In: The Program allows Users to receive SMS/MMS mobile messages by affirmatively opting into the Program, such as through online or application-based enrollment forms. Regardless of the opt-in method you utilized to join the Program, you agree that this Agreement applies to your participation in the Program. By participating in the Program, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in, and you understand that consent is not required to make any purchase from Us. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of Our mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”). Message and data rates may apply.
User Opt Out: If you do not wish to continue participating in the Program or no longer agree to this Agreement, you agree to reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from Us in order to opt out of the Program. You may receive an additional mobile message confirming your decision to opt out. You understand and agree that the foregoing options are the only reasonable methods of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.
Duty to Notify and Indemnify: If at any time you intend to stop using the mobile telephone number that has been used to subscribe to the Program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the User Opt Out process set forth above prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a material part of these terms and conditions. You further agree that, if you discontinue the use of your mobile telephone number without notifying Us of such change, you agree that you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by Us, or any party that assists in the delivery of the mobile messages, as a result of claims brought by individual(s) who are later assigned that mobile telephone number. This duty and agreement shall survive any cancellation or termination of your agreement to participate in any of our Programs.
YOU AGREE THAT YOU SHALL INDEMNIFY, DEFEND, AND HOLD US HARMLESS FROM ANY CLAIM OR LIABILITY RESULTING FROM YOUR FAILURE TO NOTIFY US OF A CHANGE IN THE INFORMATION YOU HAVE PROVIDED, INCLUDING ANY CLAIM OR LIABILITY UNDER THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227, et seq., OR SIMILAR STATE AND FEDERAL LAWS, AND ANY REGULATIONS PROMULGATED THEREUNDER RESULTING FROM US ATTEMPTING TO CONTACT YOU AT THE MOBILE TELEPHONE NUMBER YOU PROVIDED.
Program Description: Without limiting the scope of the Program, users that opt into the Program can expect to receive messages concerning the marketing and sale of Jaquish Biomedical's health, fitness, nutrition, and wellness related products.
Cost and Frequency: Message and data rates may apply. The Program involves recurring mobile messages, and additional mobile messages may be sent periodically based on your interaction with Us.
Support Instructions: For support regarding the Program, text “HELP” to the number you received messages from or email us at CS@JaquishBiomedical.com. Please note that the use of this email address is not an acceptable method of opting out of the program. Opt outs must be submitted in accordance with the procedures set forth above.
MMS Disclosure: The Program will send SMS TMs (terminating messages) if your mobile device does not support MMS messaging.
Our Disclaimer of Warranty: The Program is offered on an "as-is" basis and may not be available in all areas at all times and may not continue to work in the event of product, software, coverage or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with this Program. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of Our control. T-Mobile is not liable for delayed or undelivered mobile messages.
Participant Requirements: You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.
Age Restriction: You may not use of engage with the Platform if you are under thirteen (13) years of age. If you use or engage with the Platform and are between the ages of thirteen (13) and eighteen (18) years of age, you must have your parent’s or legal guardian’s permission to do so. By using or engaging with the Platform, you acknowledge and agree that you are not under the age of thirteen (13) years, are between the ages of thirteen (13) and eighteen (18) and have your parent’s or legal guardian’s permission to use or engage with the Platform, or are of adult age in your jurisdiction. By using or engaging with the Platform, you also acknowledge and agree that you are permitted by your jurisdiction’s Applicable Law to use and/or engage with the Platform.
Prohibited Content: You acknowledge and agree to not send any prohibited content over the Platform. Prohibited content includes:
- Any fraudulent, libelous, defamatory, scandalous, threatening, harassing, or stalking activity;
- Objectionable content, including profanity, obscenity, lasciviousness, violence, bigotry, hatred, and discrimination on the basis of race, sex, religion, nationality, disability, sexual orientation, or age;
- Pirated computer programs, viruses, worms, Trojan horses, or other harmful code;
- Any product, service, or promotion that is unlawful where such product, service, or promotion thereof is received;
- Any content that implicates and/or references personal health information that is protected by the Health Insurance Portability and Accountability Act (“HIPAA”) or the Health Information Technology for Economic and Clinical Health Act (“HITEC” Act); and
- Any other content that is prohibited by Applicable Law in the jurisdiction from which the message is sent.
Dispute Resolution: In the event that there is a dispute, claim, or controversy between you and Us, or between you and Stodge, LLC d/b/a Postscript or any other third-party service provider acting on Our behalf to transmit the mobile messages within the scope of the Program, arising out of or relating to federal or state statutory claims, common law claims, this Agreement, or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, such dispute, claim, or controversy will be, to the fullest extent permitted by law, determined by arbitration in Nevada City, California before one arbitrator.
The parties agree to submit the dispute to binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) then in effect. Except as otherwise provided herein, the arbitrator shall apply the substantive laws of the Federal Judicial Circuit in which Jaquish Biomedical Corporation’s principle place of business is located, without regard to its conflict of laws rules. Within ten (10) calendar days after the arbitration demand is served upon a party, the parties must jointly select an arbitrator with at least five years’ experience in that capacity and who has knowledge of and experience with the subject matter of the dispute. If the parties do not agree on an arbitrator within ten (10) calendar days, a party may petition the AAA to appoint an arbitrator, who must satisfy the same experience requirement. In the event of a dispute, the arbitrator shall decide the enforceability and interpretation of this arbitration agreement in accordance with the Federal Arbitration Act (“FAA”). The parties also agree that the AAA’s rules governing Emergency Measures of Protection shall apply in lieu of seeking emergency injunctive relief from a court. The decision of the arbitrator shall be final and binding, and no party shall have rights of appeal except for those provided in section 10 of the FAA. Each party shall bear its share of the fees paid for the arbitrator and the administration of the arbitration; however, the arbitrator shall have the power to order one party to pay all or any portion of such fees as part of a well-reasoned decision. The parties agree that the arbitrator shall have the authority to award attorneys’ fees only to the extent expressly authorized by statute or contract. The arbitrator shall have no authority to award punitive damages and each party hereby waives any right to seek or recover punitive damages with respect to any dispute resolved by arbitration. The parties agree to arbitrate solely on an individual basis, and this agreement does not permit class arbitration or any claims brought as a plaintiff or class member in any class or representative arbitration proceeding. Except as may be required by law, neither a party nor the arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties, unless to protect or pursue a legal right. If any term or provision of this Section is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Section or invalidate or render unenforceable such term or provision in any other jurisdiction. If for any reason a dispute proceeds in court rather than in arbitration, the parties hereby waive any right to a jury trial. This arbitration provision shall survive any cancellation or termination of your agreement to participate in any of our Programs.
Miscellaneous: You warrant and represent to Us that you have all necessary rights, power, and authority to agree to these Terms and perform your obligations hereunder, and nothing contained in this Agreement or in the performance of such obligations will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable. Any new features, changes, updates or improvements of the Program shall be subject to this Agreement unless explicitly stated otherwise in writing. We reserve the right to change this Agreement from time to time. Any updates to this Agreement shall be communicated to you. You acknowledge your responsibility to review this Agreement from time to time and to be aware of any such changes. By continuing to participate in the Program after any such changes, you accept this Agreement, as modified.
X3 Return Policy
Your satisfaction is guaranteed. If you're not 100% satisfied with your purchase, simply contact our Customer Service department at email@example.com within 2 weeks of delivery for a Return Merchandise Authorization (RMA) number. Please note that Gift Cards are not eligible for return/refund.
Our return policy applies to products purchased directly from Jaquish Biomedical Corporation and X3Bar.com and lasts 14 days from the date of delivery. If more than 14 days have gone by since you received your order, unfortunately we can’t offer you a refund or exchange.
We accept returns of merchandise only under the following conditions:
-You must receive a RMA number from Jaquish Biomedical before shipping the product to us.
-Products returned without a RMA number will not be refunded or credited and will be discarded.
-Your return shipment must be postmarked no later than 14 days after the delivery of the product.
-Products must be returned undamaged in original packaging.
-Returns must include a notation of the RMA we provide for you and a proof of purchase.
-Returns must be in original condition with all accessories and materials included. You may test your equipment during this 14 day period, and still return it, as long as you have not damaged it during that time.
You will be responsible for paying for your own shipping costs for returning your item. Please ship your return to the address provided at the time your RMA is issued. Please do not send your return back to the address it was shipped from, else we may not be able recover your product or issue a refund.
If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
Refunds (if applicable):
Once your return is received and inspected, we will notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment within one working week. Shipping costs such as international shipping fees and expedited shipping fees are non-refundable and will be deducted from the total refund issued.
Late or missing refunds (if applicable):
If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at firstname.lastname@example.org
Sale items (if applicable):
Only regular priced items may be refunded, unfortunately sale items cannot be refunded.
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.
If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he/she will find out about your return.
Jaquish Biomedical Corp. defines an unauthorized return as any merchandise returned to our facilities without a valid and current RMA number issued by us. Failure to properly mark packages with a valid RMA number, or allowing an RMA number to expire, will cause us to consider a return unauthorized. Any merchandise returned without a RMA number will not be subject to a refund or credit and we will discard the product. The customer assumes all shipping and handling charges for any unauthorized return.
Order Cancellation Policy:
Your order begins processing as soon as you click the "Submit" button. After submission, it may be possible to cancel your order by emailing us directly. Once inventory has been allocated to your order, it cannot be canceled. IMPORTANT: Any attempts to cancel your order after it moves into the shipping process does not guarantee the order will not be shipped.
If you change your mind about the order or we are unable to stop your order, you can return any unwanted items in accordance with our return policy.
Jaquish Biomedical Corporation (“Jaquish Biomedical”) warrants to the original purchaser that all authentic X3 equipment will be free from defects in material and workmanship under normal use and service for the following periods and in the following respects:
X3 Resistance Bands: 1 year
Jaquish Biomedical warrants the bands against defects in workmanship and materials for a period of 1 year from the date of purchase.
X3 Bar and Ground Plate: 5 years
Jaquish Biomedical warrants the bar and ground plate against defects in workmanship and ma terials for a period of 5 years from the date of purchase.
If a defect arises in the X3 exercise equipment or a warranted component within the applicable Limited Warranty period, the purchaser’s sole and exclusive remedy is for Jaquish Biomedical to, at Jaquish Biomedical’s discretion either replace or repair the defective or malfunctioning equipment or component.
EXCLUSIONS AND LIMITATIONS
Any sale of Jaquish Biomedical products by an unauthorized source or by any other manner not authorized by Jaquish Biomedical shall void the warranty on the applicable product(s).
This warranty applies only to the original purchaser and is not transferable.
Under no circumstances will Jaquish Biomedical be liable by virtue of this warranty or otherwise for damage to any person or property whatsoever for any special, indirect, in cidental, secondary or consequential losses, damages, or expenses in connection with exercise products.
This warranty is expressly limited to the repair or replacement of a defective X3 exercise product of Jaquish Biomedical manufacture.
Exposure of the products to variations in ambient environmental conditions (including, for example, changes in heat, humidity, or moisture, including water saturation) may void the warranty.
This warranty does not cover normal wear and tear – including but not limited to impact damage, indentations, scratches or surface damage (including paint or powder coat fin ishes flaking on products, or abrasions caused by failure to use or maintain the product properly).
This warranty does not cover product deterioration or variations in color or marking that are ordinarily expected based on ordinary use or develop over time because of natural processes such as exposure to sunlight.
This warranty does not cover damage that is not a result of a manufacturing defect, in cluding improper assembly, inadequate maintenance, or installation of other parts or components not manufactured or supplied by Jaquish Biomedical.
This warranty does not cover damage or failure as a result of an accident, abuse, ne glect, or misuse, corrosion, use of the device other than its intended purpose, neglect, theft, vandalism, fire, flood, lightning, freezing or other natural disasters, collision, or unauthorized modifications.
This warranty does not cover rust, bending due to misuse, or any defect caused from use outside the stated functional capacity of the X3 exercise equipment.
This limited warranty does not cover services that may be provided to you by Jaquish Biomedical. The Terms of Service for any services provided by Jaquish Biomedical are posted on the www.X3Bar.com website.
Any replacement or repaired component shall be warranted for the remainder of the orig inal Limited Warranty period.
Jaquish Biomedical Shall not be liable for any incidental or consequential damages for breach of any express or implied warranty on this product.
DURATION OF IMPLIED WARRANTIES:
EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ON THIS PRODUCT IS LIMITED IN DURATION TO THE DURATION OF THE APPLICABLE PRODUCT WARRANTY AS DEFINED ABOVE IN THIS DOCUMENT.
OUR FACTORY WARRANTY IS VOID IF
You purchase Jaquish Biomedical product(s) from an unauthorized dealer or reseller.
You purchase used or pre-owned Jaquish Biomedical product(s) from a private party, facility or unauthorized source.
HOW TO OBTAIN WARRANTY SERVICE
To be eligible for service under this Limited Warranty you must contact the Jaquish Bio medical Support team at CS@JaquishBiomedical.com. You will be asked to provide proof of purchase indicating the date purchased, upon discovering any defect. Claims must be made within the specified warranty period.
Warranty service or replacement requires the return of the product, freight prepaid, in ei ther its original packaging or packaging affording an equal degree of protection to Jaquish Biomedical.
